Green House, provozovan\u00fd pod n\u00e1zvem Guaranteed Dispensary, se nach\u00e1z\u00ed p\u0159\u00edli\u0161 bl\u00edzko nedalek\u00e9 \u0161koly, \u010d\u00edm\u017e poru\u0161uje m\u011bstsk\u00e9 z\u00e1kony o \u00fazemn\u00edm pl\u00e1nov\u00e1n\u00ed.<\/p>\n\n\n\n<p>\u017dalobu podala m\u00edstn\u00ed obyvatelka Beth Paderaov\u00e1 a tvrd\u00ed, \u017ee m\u011bstsk\u00e1 odvolac\u00ed rada pro \u00fazemn\u00ed pl\u00e1nov\u00e1n\u00ed (ZBA) neopr\u00e1vn\u011bn\u011b vydala zvl\u00e1\u0161tn\u00ed povolen\u00ed k u\u017e\u00edv\u00e1n\u00ed l\u00e9k\u00e1rny na adrese 620 N. Fairbanks Court. M\u011bstsk\u00fd spr\u00e1vce \u00fazemn\u00edho pl\u00e1nu ji\u017e d\u0159\u00edve doporu\u010dil \u017e\u00e1dost zam\u00edtnout, proto\u017ee v\u00fddejna se nach\u00e1z\u00ed o n\u011bco m\u00e9n\u011b ne\u017e 500 stop od budovy Guidepost Montessori at Magnificent Mile, kter\u00e1 se nach\u00e1z\u00ed na adrese 226 E. Illinois St.<\/p>\n\n\n\n<p>A\u010dkoli spr\u00e1vce \u0161koly Montessori komunikoval s m\u011bstem, ZBA zjistil, \u017ee v dopise nebylo jasn\u011b uvedeno, \u017ee \u0161kola poskytuje \"st\u00e1tem na\u0159\u00edzen\u00e9 z\u00e1kladn\u00ed vzd\u011bl\u00e1n\u00ed\", co\u017e je nezbytn\u00e9 pro dodr\u017een\u00ed \u00fazemn\u00edho pl\u00e1nu. ZBA poznamenal, \u017ee nep\u0159\u00edtomnost z\u00e1stupce spole\u010dnosti Guidepost na sly\u0161en\u00ed nazna\u010duje nedostatek v\u00e1\u017en\u00e9ho z\u00e1jmu o tuto z\u00e1le\u017eitost.<\/p>\n\n\n\n<p>Pr\u00e1vn\u00ed poradce m\u011bsta dosp\u011bl k v\u00fdznamn\u00e9mu z\u00e1v\u011bru, \u017ee Montessori centrum skute\u010dn\u011b spl\u0148uje podm\u00ednky pro \u0161kolu, co\u017e by m\u011blo diskvalifikovat v\u00fddejnu l\u00e9k\u016f z provozu v jeho bl\u00edzkosti. \u017daloba tak\u00e9 zd\u016fraz\u0148uje obavy obyvatel, \u017ee obchod s konop\u00edm by vedl ke zv\u00fd\u0161en\u00ed dopravn\u00ed z\u00e1t\u011b\u017ee, co\u017e by m\u011blo dopad zejm\u00e9na na vozidla z\u00e1chrann\u00e9 slu\u017eby, jako jsou sanitky, kter\u00e9 se sna\u017e\u00ed dostat do nemocnice Northwestern Memorial Hospital, kter\u00e1 se nach\u00e1z\u00ed jen o blok d\u00e1l.<\/p>\n\n\n\n<p>Navzdory t\u011bmto obav\u00e1m ZBA rozhodl, \u017ee absence st\u00ed\u017enost\u00ed ze strany Northwesternu nazna\u010duje, \u017ee doprava nep\u0159edstavuje pro nemocnici v\u00fdznamn\u00fd probl\u00e9m. V m\u00edst\u011b navrhovan\u00e9 v\u00fddejny, kter\u00e1 se nach\u00e1z\u00ed v t\u0159\u00edpatrov\u00e9 budov\u011b na ulici Fairbanks a Ontario, byla d\u0159\u00edve restaurace. Pr\u00e1vn\u00edk zastupuj\u00edc\u00ed dispenz\u00e1\u0159, Jim Banks, argumentoval, \u017ee provoz nov\u00e9ho obchodu bude pravd\u011bpodobn\u011b m\u00e9n\u011b problematick\u00fd ne\u017e p\u0159edchoz\u00ed restaura\u010dn\u00ed provoz, a poznamenal, \u017ee obavy z obchod\u016f s konop\u00edm zvy\u0161uj\u00edc\u00edch kriminalitu nebo sni\u017euj\u00edc\u00edch hodnotu nemovitost\u00ed se uk\u00e1zaly jako neopodstatn\u011bn\u00e9.<\/p>\n\n\n\n<p>\u017daloba rovn\u011b\u017e tvrd\u00ed, \u017ee \u010dlenka ZBA a b\u00fdval\u00e1 radn\u00ed Helen Shillerov\u00e1 se m\u011bla z d\u016fvodu st\u0159etu z\u00e1jm\u016f odvolat, proto\u017ee jej\u00ed syn, pr\u00e1vn\u00edk Brendan Shiller, zastupoval spole\u010dnost G.P. Green House p\u0159i z\u00edsk\u00e1v\u00e1n\u00ed podm\u00edn\u011bn\u00e9 licence pro dosp\u011bl\u00e9 od st\u00e1tu. Shillerov\u00e1 v\u0161ak tvrdila, \u017ee ke st\u0159etu z\u00e1jm\u016f nedo\u0161lo, proto\u017ee jej\u00ed syn se na procesu ud\u011blov\u00e1n\u00ed povolen\u00ed m\u011bstem nepod\u00edlel.<\/p>\n\n\n\n<p>Proti povolen\u00ed se postavil m\u00edstn\u00ed radn\u00ed Brian Hopkins, kter\u00fd vyj\u00e1d\u0159il obavy ohledn\u011b dopravy a parkov\u00e1n\u00ed a zd\u016fraznil, \u017ee nedalek\u00fd obchod s alkoholem musel z\u00edskat zvl\u00e1\u0161tn\u00ed povolen\u00ed k provozu kv\u016fli bl\u00edzkosti \u0161koly. Z\u00e1stupci ZBA a G.P.
