Montgomery County Council Proposes Cannabis Dispensary Setback

The Montgomery County Council announces public hearings scheduled for June 10 and 17, 2025. These sessions aim to collect public testimony on two key topics: supplemental budget appropriations and a zoning text amendment concerning cannabis dispensaries.

The proposed zoning text amendment would require licensed cannabis dispensaries to maintain a distance of at least 100 feet from residential properties. This move is part of an effort to update existing regulations for retail and service establishments within the county.

On June 10, the council will discuss various budget resolutions, including: – A supplemental appropriation of $15,310,724 for the Montgomery County Fire and Rescue Service to cover general personnel and operational costs. This funding will come from the county’s Undesignated Fire Fund Reserves. – A supplemental appropriation of $6,210,166 for the Department of Correction and Rehabilitation, also sourced from the General Fund Undesignated Reserves. – A $9,200,000 allocation for the Department of Transportation’s Transit Services, funded by the Mass Transit Fund Undesignated Reserves. – An additional $6,380,000 for the Montgomery Housing Initiative Fund, also drawn from General Fund Undesignated Reserves. – A total of $23,839,651 for snow removal and storm cleanup, split between the Department of Transportation and the Department of General Services, again sourced from General Fund Undesignated Reserves. – A $602,651 allocation for Planned Life Cycle Asset Replacement in Montgomery County Public Schools, funded through the Aging Schools Program. – The creation of a Development District and Tax Increment Financing District in White Oak.

The June 17 hearing will focus specifically on Zoning Text Amendment (ZTA) 25-07, which will delineate the setback requirements for cannabis dispensaries and amend setback regulations for retail and service establishments more broadly.

Residents wishing to testify can do so in person or remotely. They must preregister by the day prior to the hearing on the council’s website. Options for testimony include written, audio, or video formats submitted via email or traditional mail to the County Council at 100 Maryland Ave., Rockville, MD 20850. The council advises that reasonable accommodations are available under the Americans with Disabilities Act (ADA). Requests for accommodations should be made at least five business days before the hearing date.
