Nebraska medical marijuana regulation bill fails in legislature

A proposed bill to regulate medical marijuana in Nebraska failed to advance after a close vote in the state legislature. The bill, known as LB667, aimed to establish a framework for medical cannabis regulation following strong voter support in the November election, where nearly 75% of Nebraskans favored legalization.

During Tuesday’s debate, lawmakers voted 23-22 against a cloture motion to end discussion and move the bill to the next round. State Senator Rick Holdcroft of Bellevue, who sponsored the bill, had worked to address concerns regarding the consumption of cannabis flower, which had delayed progress earlier in the session.

The debate occurred shortly after Governor Jim Pillen appointed members to the new Medical Cannabis Commission. However, Crista Eggers, executive director of Nebraskans for Medical Marijuana, criticized the governor’s choices, stating that some appointees are opposed to medical marijuana, raising concerns about the commission’s effectiveness.

Public hearings for two of the commission’s nominees, Dr. Monica Oldenburg and Lorelle Mueting, are scheduled for May 22. Citizens can submit comments about the nominees online before the hearings.

Nebraska’s medical marijuana law, which took effect after Governor Pillen signed it in December, requires the commission to meet two key deadlines: July 1 and October 1. The law also integrates members from the Liquor Control Commission into the new body.

Despite the strong public backing for medical marijuana, some state officials and law enforcement representatives continue to oppose legalization. In a recent letter, 15 sheriffs from various counties, including Douglas, Sarpy, and Lancaster, expressed their disapproval of potential medical cannabis legislation. Nebraska Attorney General Mike Hilgers and Senator Pete Ricketts have also publicly opposed the regulation of medical cannabis, further complicating efforts to establish a legal framework.

This situation highlights the ongoing challenges in advancing cannabis policy in Nebraska, even as public opinion shifts in favor of legalization. The legislative session continues to develop, and updates will be provided as the situation evolves.
