Morocco establishes rules for medical cannabis cultivation

In early October 2023, the Moroccan government advanced the implementation of Law 13-21, which regulates lawful uses of cannabis, by publishing Decree 2.24.130 in the Official Gazette. This decree outlines the specific conditions and responsibilities for agricultural cooperatives authorized to cultivate cannabis strictly for medical, pharmaceutical, and industrial purposes.

The decree details the necessary criteria that cultivation entities must meet to gain and retain authorization. While recreational cannabis cultivation remains illegal, medical cultivation is now subject to technical, agronomic, land-use, and environmental guidelines. These guidelines address agricultural practices, soil management, and environmental conservation.

The regulations apply exclusively to cooperatives formed by cultivators residing in designated government-approved areas. Currently, only the provinces of Al Hoceima, Chefchaouen, and Taounate in the Rif region are permitted for regulated cultivation. These areas have a historical context of cannabis production and are receiving focused attention due to their unique cultural aspects and the challenges of sector regulation.

By selecting these specific regions, the government aims to facilitate a transition to lawful production models while supporting local communities through rural development initiatives. Decree 2.24.130 establishes stringent traceability, security, and quality control requirements throughout the cultivation and harvesting processes. Cooperatives must maintain cultivation traceability and comply with security measures to prevent illegal sales or diversion of products.

Non-compliance with these regulations can result in severe penalties, including suspension or revocation of licenses by the National Agency for Cannabis Activity Regulation (ANRAC). The adoption of this regulatory framework marks an important phase in the implementation of Law 13-21, establishing a legal basis for non-recreational cannabis cultivation.

The decree, which is set to be fully enacted by May 15, 2025, aims to provide agricultural cooperatives with clear guidelines applicable to public administration and third parties, thereby enhancing transparency in the sector. Morocco is positioning itself to integrate cannabis cultivation into a structured and controlled economic model while promoting development opportunities in rural areas.

However, the challenge remains in transitioning from an informal economy to a regulated sector and ensuring that producers receive adequate support as they adapt to the new system. The establishment of Decree 2.24.130 signifies a critical advancement in the regulatory landscape for cannabis cultivation in Morocco.
