PharmCann, Inc., operating as PC Cultivator LLC in Lothian, Maryland, has been fined $17,500 by the Maryland Cannabis Administration (MCA) for failing to report and investigate the theft of cannabis flower by an employee. This information comes from a consent order released by the MCA detailing the violations.
The incident occurred in September 2023 when a registered agent, identified as S.C., took approximately 168 grams of cannabis flower. The MCA found several violations committed by PharmCann, including not reporting the theft to both the MCA and the Maryland State Police within the required one business day. Additionally, PharmCann provided misleading information about the agent’s departure, claiming it was unrelated to theft or diversion.
PharmCann also failed to accurately track the disposal of the stolen cannabis flower in the state’s seed-to-sale tracking system, known as METRC. Other violations included deviations from the company’s own security protocols regarding green waste disposal and not notifying the MCA about the circumstances surrounding the termination of the agent.
The consent order, dated March 12, 2025, states that PharmCann’s security personnel witnessed the agent taking the cannabis flower and later found it in the agent’s locker. Although internal documents referred to this act as “theft,” PharmCann attempted to describe it as “misappropriation,” arguing that the product never left their facility.
The MCA determined that these actions violated the Maryland Cannabis Reform Act and related regulations. Along with the $17,500 fine, PharmCann is responsible for covering the costs associated with compliance to the consent order. PharmCann’s legal counsel has agreed to the terms, waiving the right to a formal evidentiary hearing and appeal, making the agreement a public document.
